Meta filed its opposition to the Kadrey book authors’ attempt to file a 4th amended complaint and to move up the briefing of class certification to be simultaneous with summary judgment motions.
Kadrey’s proposed 4th amended complaint would add (1) new details related to the torrenting by Meta, (2) a contributory infringement claim, and (3) the loan-out companies for Plaintiffs Silverman, Golden, and Coates that were already subject to discovery by Meta. (Loan out companies are often used by artists and actors for better tax treatment on income.)
Kadrey has characterized (1) the “non-training uses” that were allegedly infringing.
