In their motion for an extension to file their opposition to the News Plaintiffs’ summary judgment motion, OpenAI and Microsoft contend that the New York Times’ statement of facts was riddled with mistakes that the New York Times belatedly corrected in a subsequent “errata” filing. The defendants also argued that they still haven’t been served with 60 exhibits of the Plaintiffs.
Yesterday, the New York Times downplayed the extent of its errata and accused OpenAI and Microsoft of failing to complete an “ongoing meet and confer” before filing their motion, which contain assertions about the extent of the errata by the New York Times that were “either mischaracterized or false,” according to the News Plaintiffs.
If Judge Stein grants a 2 week extension, New York Times asks for a 2-week extension to all briefing.
We should hear from Judge Stein soon, given the briefing schedule is tight to begin with.
