The United States’ Statement of Interest in the OpenAI MDL litigation is beginning to ripple through the other AI copyright suits. ROSS Intelligence just filed a Rule 28(j) letter of new authority, calling the Third Circuit panel’s attention to the United States’ positions on fair use explained in the Statement. Other AI companies will likely do the same.
