UPDATE: Magistrate Judge Hixson just ruled that the Joseph Saveri Law Firm can depose Mark Zuckerberg for 7 hours. Click here for the court’s order.
In a filing that occurred on the same day Judge Chhabria chastised the Joseph Saveri Law Firm for its handling of the case, the Saveri Law Firm is embroiled in a discovery dispute asking Magistrate Judge Thomas Hixson to allow them to depose Mark Zuckerberg, the CEO of Meta Platforms. Meta’s attorneys oppose the request on the so-called apex deposition doctrine, which limits the instances in which top executives of companies may be required to sit for depositions. The apex deposition doctrine is meant to avoid harassment and is encourages the discovery of the information through other available witnesses.
Will be quite interesting how Magistrate Judge Hixson rules. Of course, Mark Zuckerberg is a highly experienced witness in his testimony before Congress–and it will likely be difficult for the plaintiffs to elicit any damaging testimony from him.
