As the OpenAI MDL litigation is already in the summary judgment phase, OpenAI was hit with yet another tag-along copyright lawsuit, this one filed by USA Today.
The Complaint raises 3 claims:
- Copyright Infringement
- Vicarious Infringement
- DMCA 1202 CMI removal
These are the same 3 claims that remain in the New York Times’ suit against OpenAI. Similar copyright suits have also been filed in:
- Daily News v. Microsoft
- California Newspapers Partnership v. Microsoft
- Richner Communications v. Microsoft
- Seattle Times + Newsday v. OpenAI
- Times Publishing Co. v. Microsoft, OpenAI
- Emmerich Newspapers v. Microsoft
In addition, OpenAI faces lawsuits from the following news media:
- Ziff Davis v. OpenAI
- Center for Investigative Reporting v. OpenAI
- Raw Story v. OpenAI
- Intercept v. OpenAI
- U.S. News & World Report v. OpenAI
- Encyclopaedia Britannica v. OpenAI
OpenAI faces the most copyright lawsuits of all AI companies in the world — 29 suits in the U.S. alone. That’s almost double the amount faced by Meta, which has the 2d most copyright suits at 17.
