Judge Scott Corley finds Ted Entertainment alleged sufficient “access control” for YouTube videos to state DMCA 1201(a) claim

Ted Entertainment just scored a big victory in one of the many DMCA anti-circumvention cases it has filed. In Ted Entertainment v. Bytedance, Judge Scott Corley held that Ted’s First Amended Complaint sufficiently alleged that YouTube videos are protected by “access controls,” and that Bytedance circumvented them.

The viewing of YouTube videos is somewhat different from gaining access to the music files in YouTube videos, but at least two federal judges have found sufficient allegations of access controls related to music files in YouTube videos (see below).
