The Third Circuit just published its decision affirming summary judgment to Thomson Reuters and rejecting fair use in ROSS Intelligence’s use of Westlaw headnotes in memos to train its AI model.
This is a huge win for Thomson Reuters. But the Third Circuit distinguishes this case from generative AI cases, such as Bartz and Kadrey. (see p. 17 n. 7).
