Magistrate Judge Oliver deferred ruling on whether Alon Entertainment, the plaintiff, should get the chance to depose Elon Musk.
With Mark Zuckerberg being deposed twice in Kadrey v. Meta, it’s hard to see any reason why Musk shouldn’t be required to sit for a deposition. In fact, Musk used the alleged infringing still image at issue during a presentation for Tesla.
