Kadrey files reply to support bid for interlocutory appeal of downloading issue

The Kadrey book authors filed their reply in support of their bid to have Judge Chhabria certify, for interlocutory appeal, the part of his ruling on the initial acquisition of books from online sources.

Judge Chhabria ruled that Meta’s downloading was for the purpose to train Meta’s AI models, in granting partial summary judgment on fair use.

Past briefing:

The cluster of cases against Meta has grown. Most of the book author-publisher lawsuits are before Judge Chhabria; the exceptions are Elsevier and Hobbs in the Southern District of New York (with Meta seeking to have them transferred). It will be quite interesting how Judge Chhabria rules.
