Meta loses bid for quick dismissal of adult video producer Strike 3 Holdings’ copyright case

Judge Eumi Lee denied Meta’s attempt to dismiss the copyright lawsuit filed by the adult video producer Strike 3 Holdings.

Meta had argued that the complaint of Strike 3 failed to allege that Meta played a part in the alleged torrenting of adult videos by some employees at Meta perhaps on their own accord.

Judge Lee, however, found the allegations in the complaint sufficiently alleged possible coordination in torrenting various files, suggesting that “that Defendant engaged in a coordinated effort to gather data through BitTorrent, including by torrenting Plaintiffs’ films.”

Here’s the key part:

Part of Judge Lee's decision
Part of Judge Lee's decision
Part of Judge Lee's decision

Of course, this ruling is only at the motion to dismiss stage. Summary judgment could be a different story if Strike 3 fails to provide any evidence of the alleged coordination of torrenting of its videos by Meta, the defendant.

On the other hand, if Strike 3 can produce such evidence, it could prove to be a big problem for Meta.
