Judge Lee stays Concord Music v. Anthropic I 90 days. Summary judgment hearing moved from July to Oct. 21

Due to complications created by Concord Music’s recent effort to voluntarily dismiss its 2 claims for secondary liability, along with the coordination of the recently filed related cases in Concord Music v. Anthropic II and BMG Rights Management v. Anthropic, Judge Lee sua sponte ordered a 90 day temporary stay of all the cases (except as specified in her order).

The upshot is that the hearing on the summary judgment motions gets pushed back from July 15 to October 21. See below:

At this point, it’s unclear whether any ruling on summary judgment on AI training and fair use will happen in 2026.

There’s still a chance we get 1 or 2, from Judge Lee in Concord Music v. Anthropic I, Judge Breyer in In re Mosaic LLM Litigation, and Judge Stein in In re OpenAI Copyright Infringement Litigation (MDL).

But it’s not guaranteed. For a reference point, in Bartz v. Anthropic, the hearing was on May 15. Judge Alsup issued his opinion on fair use on June 23. A pretty fast turnaround, but probably not one we should expect in other cases. The hear in Kadrey v. Meta was on May 1. Judge Chhabria’s opinion came out on June 24. Yes, a day after Judge Alsup’s opinion.

So, let’s say we use a 2-month turnaround as an approximate timeline, a decision in Concord Music I would come near the holiday period (around Dec. 21), which case one could easily see it pushed into the beginning of 2027.
