Kadrey v. Meta gets scheduling order. Summary judgment motion hearing for distribution claim won’t be heard until Feb. 25, 2027

The second phase of the Kadrey v. Meta case just received a scheduling order. The hearing on summary judgment motions related to the additional claims related to Meta’s torrenting of books won’t be heard until Feb. 25, 2027!

The first summary judgment motion in the first phase of the case was decided back on Jun. 25, 2025. This case slowed down especially after the related case Entrepreneur Media was added.

Here’s the Schedule:

Opening Reports due by 9/18/2026.

Rebuttal Reports due by 10/16/2026.

Reply Expert Reports due by 10/30/2026.

Close of Expert Discovery due by 11/20/2026.

Deadline for Summary Judgment Brief 1 (Plaintiffs Opening Brief) due by 12/11/2026.

Deadline for Summary Judgment Brief 2 (Defendants Opening Brief & Opposition) due by 1/11/2027.

Deadline for Summary Judgment Brief 3 (Plaintiffs Opposition & Reply) due by 1/29/2027.

Deadline for Summary Judgment Brief 4 (Defendants Reply) due by 2/12/2027.

Dispositive Motion Hearing set for 2/25/2027 at 10:00 AM in San Francisco, Courtroom 04, 17th Floor before Judge Vince Chhabria.
