- Trial in Musk v. Altman is set to start on April 27, 8:30 AM, in Oakland federal district court.
- Judge Yvonne Gonzalez-Rogers issued her first Pretrial Order..
- She indicated that this case is unlikely to be a punitive damages case; a separate order will follow.
- An overflow room will be provided for people to watch the trial if the courtroom is filled.
Judge Yvonne Gonzalez-Rogers issued her Pretrial Order No. 1 in the much anticipated trial in Musk v. Altman.
One of the most interesting revelations in the Order is that the judge said it is “unlikely that punitive damages will be available” in this case (a separate order will follow). But the Judge left open the door that punitive damages phase could occur and set forth instructions regarding it (in paragraph 27), including:
“Counsel shall have all witnesses who will be called to testify regarding the financial status of the relevant party (e.g., to authenticate relevant documents, etc.) available on 30 minutes’ notice once jury deliberations begin[.]”
The trial will be held Monday through Thursday, starting on April 27, and run from 8:30 AM to 1:40 PM in Oakland federal district court.
Best of all, there will be “[o]verflow courtroom access … with video feed for those sessions which are anticipated to be oversubscribed.”
So that presumably means if you want to attend the trial, you should be able to see it at least in the overflow room.
