Judge Breyer has granted the Plaintiffs’ motion for leave to file a Second Amended Complaint in the copyright suit against Databricks and Mosaic.
The plaintiffs had sought: “Plaintiffs seek an order granting their Motion for Leave to File a Second Amended Consolidated Complaint and to modify the scheduling order based on evidence recently disclosed. The proposed SACC would (1) add a direct infringement claim against Defendant Databricks based on its use of Plaintiffs’ works to develop its LLMs; (2) add a contributory infringement claim against Defendants Databricks and MosaicML based on their [REDACTED]; (3) add an inducement of infringement claim against Defendants Databricks and MosaicML for [REDACTED] and (4) update the proposed class definition to reflect Defendants’ newly discovered conduct.”
This grant follows the recent grant by Judge Tigar’s allowance of leave for plaintiffs in another case to file a First Amended Complaint against NVIDIA.
