OpenAI got hit with another copyright suit. U.S. News just sued OpenAI for its alleged use of U.S. News rankings and articles. This is the 16th copyright lawsuit filed against OpenAI and the 63rd copyright lawsuit filed against AI companies in the United States.

The Complaint alleges:”OpenAI created and distributed reproductions of the USNWR’s material in several, independent ways in the course of (i) pre-training, training, and fine-tuning its LLMs and (ii) operating the products that incorporate them.”

Counts:

(1) Copyright infringement in scraping copies and training (including storing, processing, and reproducing training datasets including plaintiffs’ works) and outputs of ChatGPT,

(2) Contributory infringement,

(3) DMCA CMI 1202(b)(1) claim,

(4) Trademark Infringement, 15 U.S.C. s. 1114,

(5) Trademark Counterfeiting, 15 U.S.C. 1114, 1127,

(6) False Designation of Origin and Dilution of Plaintiff’s Trademarks, 15 U.S.C. s. 1125,

(7) Dilution and Injury to Business Reputation (N.Y. Gen. Bus. Law § 360-l).

U.S. News is represented by Steven LiebermanJennifer B. MaiselKristen J. LoganBryan B. Thompson, ROTHWELL, FIGG, ERNST & MANBECK, P.C.

This is the fourth copyright lawsuit filed by lawyers from ROTHWELL, FIGG. The others: New York Times, Daily News, California Newspaper Partnership.

The case has already been deemed a related case to the In re OpenAI Copyright Infringement Litigation and assigned to Judge Sidney H. Stein. Things haven’t been going well in that MDL case, where OpenAI has suffered a string of major loses, including its attorney-client privilege as to deletion of Books 1 and 2 datasets (although OpenAI is appealing the Magistrate Judge’s controversial decision).

This lawsuit comes at a time when OpenAI is facing mounting business and financial pressure.
