The Bartz book authors, who were successful in securing a $1.5 billion settlement in their copyright suit against Anthropic, now face a new foe: an Arizona based firm called ClaimsHero, which touts itself as “a platform and law firm dedicated to helping individuals seamlessly collect what’s theirs.“
On its website, ClaimsHero tracks class actions, especially settlements, and then apparently invites potential class members to use ClaimsHero’s service in some ways.
But the Class Counsel for Bartz now alleges that ClaimsHero’s platform was or is misleading in the way it was and is offering services for Bartz class members. Bartz Class Counsel calls the pitch by ClaimsHero as a “bait-and-switch,” making people believe they are filing a claim for money when all they are really doing is opting out of the class settlement and giving up their claim to $3,100 per work from the class fund.
ClaimsHero’s landing page for the Anthropic lawsuit is here. In its earlier motion, Bartz alleged that ClaimsHero has modified its website after Bartz complained, but the changes are not satisfactory.
Who are the lawyers representing ClaimsHero?
Just 3 days ago, Bartz filed a motion with Judge Alsup seeking an order limiting the allegedly misleading overtures ClaimsHero can make to class members.
Now, Bartz has filed an ex parte motion asking Judge Alsup to hold an expedited hearing on its motion on November 12 or at the Judge’s earliest convenience. We can probably should expect the motion has a high likelihood of being granted, given the importance of the issue and a delay until December 11 might adversely affect the operation of the class claims process.
