Judge Chhabria granted the parties’ request for an extension to the scheduling order of 50 and 60 days to the deadlines, in light of “new evidence” Meta recently discovered and produced to the Kadrey plaintiffs. After Judge Chhabria’s momentous grant of partial summary judgment on fair use to Meta, this case has become relatively quiet.
A bunch of cases appear to be getting extensions (this, In re Google Generative AI, In re Mosaic AI Litigation, and potentially Concord Music v. Anthropic, UMG Recording v. Suno, UMG Recordings v. Udio).
These extensions delay both the next decision on fair use AI training and any subsequent appeals. It’s unclear if the delay favors either side.
