With a meticulous eye, Judge William Alsup picked apart inconsistencies and gaps in the claims process proposed for the class action settlement in Bartz v. Anthropic.
The Judge is clearly concerned about a situation involving multiple copyright holders in a work for which not all elect to opt into the class.
He’s also concerned about the scope of Anthropic’s release and whether, e.g., it applies to the scanned books as well. At the hearing, the Judge did express concern that the settlement not leave Anthropic exposed to numerous litigation in the future.
He asked both sides to answer 17 questions to address these problems by September 23.
