Judge Wu gave his tentative ruling on the defendants’ motion to dismiss the 2d amended complaint in Alcon Entertainment v. Tesla. The hearing is in-person on Thursday, Sept. 11, at 8:30 AM.
It sounds like the direct infringement claims against Elon Musk and Tesla remain, plus, although the tentative ruling does not mention it, it appears Count 3 for contributory infringement against all defendants does as well, as far as I can tell from the ruling. Everything else will be dismissed.
And Judge Wu warns that the plaintiff must keep its next complaint within 20 pages.
