Oh boy. Meta just found 18,000 Meta documents that it hasn’t reviewed yet in response to the Kadrey plaintiffs’ discovery requests. Meta blames its “e-discovery vendor” that apparently conducted its review.
Meta discovered this gaping lapse in its vendor’s e-discovery review in the course of preparing the attorney-client communications it must submit to Judge Chhabria for his in-camera review for potential evidence of criminal copyright infringement activity engaged in by Meta counsel justifying the crime-fraud exception to the attorney-client privilege.
This has disaster written all over it.
