The David Boies law firm sent Judge Chhabria a letter, identifying 7 additional Meta documents that “appear to show similar attorney involvement in a crime, fraud, or unlawful conduct.”
Judge Chhabria has already ordered Meta to submit for his in-camera review “the documents identified in Exhibit J to the Pritt declaration (as well as well as those in Appendix A to the plaintiffs’ motion and in Exhibit A to the parties’ joint letter brief on the crime-fraud exception submitted to Judge Hixson).”
It’s unclear how many documents are involved because the exhibits are filed under seal.
If Judge Chhabria finds that the crime-fraud exception applies and all the attorney-client communications identified by the Boies’ law firm lose their privilege, the documents could look quite incriminating to a jury. Stay tuned.
