David Boies firm seeks to file 3rd Amended Complaint v. Meta to add DMCA claim and California data access & fraud claim

In a heavily redacted notice of motion, David Boies’ law firm, representing the Kadrey plaintiffs in the lawsuit against Meta, seeks leave to file a 3rd Amended Complaint against Meta.

The notice alleges that the plaintiffs have obtained evidence from Meta during discovery that provides the basis for adding the additional claims of (1) DMCA 1202 claim for CMI (previously dismissed by Judge Chhabria without prejudice) and (2) a California Comprehensive Computer Data Access and Fraud Act claim.

The redactions are too great to understand what the plaintiffs allegedly found during discovery.

The plaintiffs also seek to define the AI model LLAMA to include all versions, or “the entire family of language models.”
