On Tuesday, we reported that the Daily News and 7 other major newspapers filed 2 copyright lawsuits, one against OpenAI and Microsoft and the other we suspected was Google. But, as we reported, mysteriously, the docket entry for the second lawsuit lacked the complaint and the name of the defendant.
Because this lasted for more than 24 hours, we revised our initial report and removed the second lawsuit, pending further information.
Well, now, the Clerk’s office in the Southern District of New York has asked the plaintiffs’ attorney for the Daily News to file its initial pleading.
So, yes, there appears to be a second lawsuit. It has an official docket number. But no complaint. It could be a mistake by the lawyers involved. Either there’s only one lawsuit (the one against OpenAI and Microsoft) or there’s 2 lawsuits and the second complaint was mistakenly not filed.
