Judge Martínez-Olguín rejects Plaintiffs’ motion in California case to enjoin OpenAI from defending different lawsuit in New York

The Joseph Saveri Law Firm, representing the book author plaintiffs in In re ChatGPT Litigation in the Northern District of California, filed a curious motion to enjoin OpenAI from defending itself in the different case, Authors Guild v. OpenAI, filed in the Southern District of New York. The Joseph Saveri Law Firm appeared to be angling to be named class action counsel in the book author cases against OpenAI.

Judge Martínez-Olguín rejected the motion, holding there was no legal precedent supporting enjoining a defendant from defending itself in another lawsuit subsequently filed.
