Sarah Silverman and Richard Kadrey’s lawyers faced skepticism from Judge Vince Chhabria about the theories of some their claims, in their proposed class action against Meta for its generative AI program.
According to Reuters, Judge Chhabria said, “I understand your core theory. Your remaining theories of liability I don’t understand even a little bit.”
Indeed, for the plaintiffs’ broadest theory in Kadrey v. Meta Platforms Inc, No. 3:23-cv-03417, Judge Chhabria said, It “would have to mean that if you put the Llama language model next to Sarah Silverman’s book, you would say they’re similar. That makes my head explode when I try to understand that.”
Judge Chhabria announced that he planned on granting the defendant’s motion to dismiss some of the claims.
Judge Chhabria’s skepticism and expected dismissal of some of the plaintiffs’ claims follow Judge Orrick’s order partially granting the defendant’s motion to dismiss in the artist Sarah Anderson’s proposed class action against Stability AI.
