This week, various individuals (myself included) and entities have asked Judge Stein for leave to file amicus briefs in the OpenAI MDL litigation.
By my unofficial count, 52 proposed amicus briefs were filed, with the following breakdown:
- 26 briefs in support of Plaintiffs
- 18 briefs in support of Defendants
- 8 briefs in support of neither side

The large number of amicus briefs reflects the importance of the issues at stake. But the Open MDL (which involves a cluster of News and Books cases) is not the only lawsuit raising many of the same issues. Currently, there are 158 copyright suits (including the ones in the OpenAI MDL), but this case has received the greatest and perhaps disproportionate attention.
More analysis to follow. Stay tuned.
