In the OpenAI MDL litigation, the New York Times bestselling book author and founding executive editor of Wired, Kevin Kelly, just filed a proposed amicus brief vigorously defending fair use in OpenAI’s training of its models.
This is the first amicus brief Kelly has filed in any of the AI cases.
The brief was filed early on the original deadline, which has been extended to October 30. By filing early, Kelly’s brief has drawn attention. Many more briefs are likely to be filed by the deadline.
