In OpenAI MDL, Judge Stein strikes Tuhin Chakrabarty “dilution” paper and Michael Lasinski Supplemental Report based on it

In a short order, Judge Sidney Stein granted OpenAI’s motion to strike the paper of Dr. Tuhin Chakrabarty on the theory of “dilution” and the Supplemental Report of expert Michael Lasinski based on the paper that Plaintiffs had submitted. Plaintiffs ended up not opposing OpenAI’s motion. Ergo, Judge Stein’s order states:

The motion by defendants OpenAI and Microsoft to strike the Lasinski Supplemental Report and to preclude Class Plaintiffs from citing or relying upon the paper by Class Plaintiffs’ expert Dr. Tuhin Chakrabarty entitled, “Generative AI Floods and Dilutes the Market for Books” (the “Chakrabarty Paper”) is granted without opposition. (Dkt. Nos. 2045; 2087.)
