New York Times and other news plaintiffs filed a motion for discovery sanctions against OpenAI for its alleged concealment of the ability to conduct relevant searches that the plaintiffs had requested, which they news plaintiffs say they discovered from the 2d deposition of Vincent Monaco:
“Instead, its two-year effo1t to hide its ability to search its training data and output logs for News Plaintiffs’ copyrighted content surfaced only dming the second deposition of its five-time declarant and Rule 30(b)(6) witness Vincent Monaco, whom the Comt ordered re-deposed for lack of preparation and OpenAI’s obstrnction of his first deposition. Dkt. 1492. OpenAI had repeatedly claimed that it could not conduct such searches to respond to News Plaintiffs’ discove1 y requests, but Monaco admitted [REDACTED PORTION].”
Magistrate Judge Ona Wang instructed the parties to confer and submit a proposed briefing schedule: “The Court is in receipt of News Plaintiffs’ motion for sanctions against Defendant OpenAI at ECF 1618. Parties are directed to meet and confer and file a proposed briefing schedule for the reply and response briefs by Friday, July 17, 2026.”
