Book author John Carreyrou’s bold attempt to pursue an omnibus copyright lawsuit against the U.S. AI industry appears possibly splintering apart.
Google already filed a motion to sever. And today Anthropic followed suit (see below). We can expect the same motions to sever from Meta, Perplexity AI, and xAI.
The case against OpenAI has already been severed after a joint stipulation between the parties, so it can be transferred to the MDL litigation against OpenAI, already well toward the end of discovery.
Unfortunately, we won’t see Sam Altman and Elon Musk on the same side!
Anthropic interprets Judge Thompson’s recusal as applying to the entire case (despite the caption for her order being titled Carreryrou v. Google LLC, et al.). It’s unclear why the caption in the recusal order wasn’t the original caption, Carreyrou v. Anthropic. But the order is addressed to “ALL PARTIES AND COUNSEL OF RECORD.” In any event, it looks like this entire case will get reassigned to a new judge.
