Anthropic moves to dismiss John Carreyrou’s lawsuit filed by 5 authors who opted out of the Bartz class settlement

Anthropic wasted no time in moving to dismiss author John Carreyrou’s copyright complaint.

The lawsuit was filed by 5 book authors (a sixth dropped out) who opted out of the Bartz v. Anthropic class settlement.

Intriguing is Anthropic’s argument that John Carreyrou’s Complaint fails to allege his book(s) were contained in the dataset (Books3) Anthropic allegedly downloaded:

Also intriguing is Anthropic’s argument that John Carreyrou’s lawsuit fails the 3-year statute of limitations because, as argued in his Complaint, Anthropic disclosed the use of the so-called shadow library Books 3 in a white paper published online on Dec. 9, 2021.

Yet, Carreyrou’s lawsuit was filed on Dec. 22, 2025. Anthropic argues: “The Complaint does not allege when Plaintiffs first learned of the alleged infringement and does not allege any facts supporting tolling or delayed accrual.”
