Concord Music Group and Anthropic have raised whetherConcord Music Group v. Anthropic II should be a related case to Concord Music Group v. Anthropic I.
If Judge Lee deems the case related, the Concord Music Group II case would be assigned to her. She already presides over the first case.
The irony is that Judge Lee denied Concord Music’s belated attempt to amend the complaint to add the same allegations related to Anthropic’s alleged downloading of lyrics from shadow libraries.
Concord Music doesn’t take a definitive position on whether to relate the cases, suggesting the 2d lawsuit may raise some distinct issues and theory of liability based on Anthropic’s alleged downloading from shadow libraries.
By contrast, Anthropic argues for treating the cases as related and both being assigned to Judge Lee. If the second case is related, the result will be very similar to what would have happened had Judge Lee allowed Concord Music’s motion to amend.
