Magistrate Judge Wang just gave OpenAI until midnight tonight to file any objection to the Plaintiffs’ request for 2 memos written by Ilya Sutskever and all deposition transcripts from the Musk v. Altman lawsuit (which itself is headed to trial) in April).
ORDER re: (1178 in 1:25-md-03143-SHS-OTW) Letter, filed by The New York Times Company. If OpenAI objects to the production as described in the last paragraph of ECF 1178, it shall file its objection by 11:59pm Eastern time TONIGHT.
If no objection is filed, the production shall be made by 6:00pm Eastern on Monday, January 26. The production may also be made at any time before Monday at noon if OpenAI does not object.
The Plaintiffs’ letter is below. In it, the Plaintiffs mention: “Because one of these memos [written by Sutskever] addressed concerns about Mr. [Greg] Brockman, whose deposition is scheduled for next week, January 29, Plaintiffs request prompt production.”
But one thing that might be unclear: The Plaintiffs asked for all deposition transcripts, including of Sutskever. But the final paragraph–that Magistrate Judge’s Order specifically addresses–only pertains to Sutskever’s deposition. It may be the other depositions can be handled latter.
