Judge Stein upheld Magistrate Judge Wang’s order that OpenAI must produce 20 million ChatGPT chat logs to the plaintiffs in the MDL litigation.
OpenAI’s pending Rule 72(a) objection to Magistrate Judge Wang’s decision finding that OpenAI waived its attorney-client privilege related to deletion of Books 1, 2 datasets remains before Judge Stein. OpenAI, represented by Lisa Blatt, has asked for oral argument on that motion. This strikes me as an issue even bigger than the 20 million ChatGPT logs.
