OpenAI enlists Lisa Blatt to handle appeal to Judge Stein of major discovery ruling by Magistrate Judge Wang

OpenAI enlisted Lisa Blatt of Williams & Connolly, the prominent Supreme Court litigator, to handle the appeal to Judge Stein of the controversial discovery decision by Magistrate Judge Wang finding OpenAI waived its attorney-client privilege. Blatt “has argued 55 cases before the United States Supreme Court and has an 81% win rate in cases decided,” including successfully the fair use decision in Andy Warhol Foundation v. Goldsmith.

Although Blatt already represents OpenAI in two appeals (Doe 1 v. Github and Raw Story Media v. OpenAI), this is the first time she is appearing in the MDL district court for OpenAI.

Along with Blatt, Charles McCloud, Edward Pickup, and Max Alvarez of Williams & Connolly also filed notices of appearances today in the MDL litigation.

Immediately, with today’s filing, Blatt asked Judge Stein for an oral argument.

As I’ve written about extensively, I believe OpenAI has strong arguments that the Magistrate Judge committed legal error in finding a waiver of attorney-client privilege. See below.
