Elon Musk’s xAI, represented by the Clement & Murphy law firm co-founded by Paul Clement and Erin Murphy, filed a lawsuit in the Central District of California challenging California’s AB 2013, the Generative AI Training Data Transparency Act, which goes into effect on Jan. 1.
The law requires AI developers to disclose detailed summaries of datasets used for training generative AI systems on their websites.
Here are the Claims:
Count 1: Per Se Takings in violation of the Fifth Amendment of the U.S. Constitution
Count 2: Regulatory Takings in violation of the Fifth Amendment of the U.S. Constitution
Count 3: Violation of the First Amendment Requiring Compelled Speech
Count 4: Unconstitutional Vagueness in Violation of the Due Process Clause of the 14th Amendment
