Book Authors spar with OpenAI, Microsoft over discovery related to books datasets, Bing Index, waiver of attorney-client privilege

On October 29, Magistrate Judge Ona Wang will hold a discovery conference to go over disputes between the parties. Let’s take a look at the discovery disputes between the book authors (aka “class” plaintiffs) and OpenAI and Microsoft.

Issues:

  1. Whether “OpenAI has been wrongfully withholding their file of copied LibGen books, the “LibGen Test File,” in discovery since 2024.”
  2. Whether “OpenAI has produced every document it was ordered to produce in the Court’s October 1, 2025 Order and offered to re-review additional documents.”
  3. Whether OpenAI has waived attorney-client privilege related to its removal of the Books1 and Books2 datasets.
  4. Whether the court should “compel Microsoft to produce or make available for inspection the Bing Index.”
