Judge Tigar has granted the Nazemian plaintiffs’ motion to amend the scheduling order, extending most of the deadlines another month.
Replies to summary judgment motions won’t be due until Dec. 4, 2026.
This does not really affect the order of judges who will have the next chance to decide fair use in AI training, which currently is as follows:
- May 6, 2026 – In re Google Gen AI Litigation last day for hearing on SJ (Judge Lee); MOTION to Amend Case Schedule filed by Consolidated Plaintiffs. Motion Hearing set for 11/5/2025 10:00 AM in San Jose, Courtroom 7, 4th Floor before Judge Eumi K. Lee.

- June 19, 2026 – UMG Recordings v. Suno SJ motions due (Judge Saylor IV)*
- July 10, 2026 – In re Mosaic LLM Litigation replies on SJ due (Judge Breyer)*
- Oct. 16, 2026 – In re ChatGPT Infringement Litigation replies on SJ due (Judge Stein)
- Nov. 4, 2026 – Andersen v. Stability AI hearing on SJ (Judge Orrick)
- Dec. 4, 2026 – Nazemian, Dubus v. NVIDIA replies due on SJ (Judge Tigar)
