Second Circuit allows Suno, Udio to file amici brief even though oral argument already held on Feb. 5, 2024

The Second Circuit has allowed Suno and Udio to file their amicus brief in support of neither party in the case, Yout, LLC v. RIAA, a case involving “stream ripping” sound tracks from YouTube videos.

The Second Circuit already held oral argument — back in February 2024, an appeal of a district court decision against Yout in 2022.

The Second Circuit has allowed both parties to file supplemental briefs in response to the amici brief: “Plaintiff-Appellant and Defendants-Appellees may file supplemental briefs, not to exceed
twenty double-spaced pages in length, in response to the arguments raised by Amicus.
If they choose to do so, the parties shall file their supplemental briefs by Monday,
November 10, 2025.”
