The dormant copyright cases v. AI companies

Among the 41 copyright lawsuits against AI companies, a few seem to be dormant or proceeding at a glacial pace. Here’s a list:

  1. Getty Images v. Stability AI (Del.): last substantive docket entry was Nov. 25, 2024 regarding Rule 26(f) conference.
  2. Huckabee v. Meta Platforms (SDNY): pending motion to dismiss. Last substantive docket entry was May 30, 2025 re: supplemental authority of the U.S. Copyright pre-publication report on AI training.
  3. Peirce v. Photobucket (Colo.): extension of time for Defendant to file Reply in support of motion to compel arbitration until June 6, 2025.
  4. Lehrman v. Lovo (SDNY): pending motion to dismiss. Last substantive docket entry was Jan. 31, 2025.
  5. Brave Software v. News Corp. (N.D. Cal.) : Last docket entry was Mar. 17, 2025. Not clear what’s going on here.
  6. Basbanes v. Microsoft (SDNY): stayed pending ruling on class certification. Now in MDL.
  7. Millette v. OpenAI: stayed by agreement of counsel. Now in MDL.

Meanwhile, Millette voluntarily dismissed its lawsuits against NVIDIA and Google.
