At hearing for class certification, Judge Alsup rejects all Anthropic’s sealing motions. Must pare down.

Judge William Alsup held a hearing on the Bartz book authors’ motion for class certification. He took it under advisement.

He also rejected all the motions of Anthropic to see various parts of submissions, including the names of datasets used to train its AI model, Claude. No surprise. Anthropic was very aggressive in trying to seal a lot of information as business secrets. (Judge Chhabria also denied a lot of Meta’s requests to seal and chided Meta for its overbroad requests.)

ORDER: “Court will take the motion under submission. Further, Court ruled all sealing motions will be denied absent omnibus motion(s) renewing and paring down – not patching up, but dramatically paring down – the prior sealing motions. The omnibus motion(s) shall conform to all ordinary requirements as well as indicate what material was previously requested to be redacted (e.g., orange highlight) and what reduced portion is now to be redacted (e.g., in clearly visible red or green outline) and is due to be filed 5/22/2025 at 12:00pm noon.”

The hearing on Anthropic’s motion for summary judgment on fair use is also that day and time: “Motion hearing re: 122 Motion for Summary Judgment is ADVANCED to be heard for oral argument from 5/23/2025 to 5/22/2025 at 12:00pm noon in San Francisco, Courtroom 12, 19th Floor before Judge William Alsup.”
