Judge Lee issued a tentative ruling on Google’s motion to dismiss the complaint in the consolidated cases filed by Leovy and Zhang. Judge Lee emailed the tentative to the parties and discussed it at today’s oral argument, but didn’t publish it.

According to Annelise Levy of Bloomberg Law who attended the hearing, “Judge Eumi K. Lee gave the parties her tentative order before the hearing. She indicated she’d likely allow some of the artists’ direct infringement claims to continue, while dismissing others along with vicarious infringement allegations against Alphabet Inc. Lee didn’t finalize the ruling during the hearing in San Jose, California.”
