Finally, the parties in Sarah Andersen v. Stability AI are headed for discovery. They filed their Joint Case Management Statement. Judge Orrick assigned the case to Magistrate Judge Lisa Cisneros for discovery.
This was the first copyright lawsuit filed after the launch of OpenAI’s ChatGPT. It is noteworthy in that Judge Orrick allowed the plaintiffs to pursue a “compressed copies” theory of infringement and active inducement.
