Rep. Adam Schiff introduced a bill titled the Generative AI Copyright Disclosure Act.
According to his press release, the bill “would require a notice to be submitted to the Register of Copyrights prior to the release of a new generative AI system with regard to all copyrighted works used in building or altering the training dataset for that system. The bill’s requirements would also apply retroactively to previously released generative AI systems.”
- Future AI models: the list of copyrighted works must be filed by 30 days before the models are made publicly available.
- For existing AI models: the list of copyrighted works must be filed by 30 days after the Act goes into effect.
- Failure to provide such notice to the Copyright Act “shall be assessed a civil penalty in an amount not less than $5,000.“
- Public database: “The Register shall establish and maintain a publicly available online database that contains each notice filed under subsection (a)(1).”
