Not surprisingly, Judge Orrick upheld Magistrate Judge Cisneros’ ruling that barred the expert for Andersen artist plaintiffs, Dr. Ben Zhao, from accessing the confidential datasets and information of the defendants Stability AI, Midjourney, and others.
Dr. Zhao is famous for developing self-help tools for artists, such as Nightshade, to “poison” copies of their works online to sabotage the effectiveness of AI image generators in generating in response to prompts.
